Regardless of size, they have to allow you time off for maternity leave under FMLA. They do not have to pay you for it, however. If they allow you to take time off, you can not file unemployment, because, technically, you are not unemployed. If you quit, your state’s laws concerning unemployment would determine your eligibility.

No. You cannot draw unemployment unless you are willing and able to work.

Call some of those pro-life groups. They SAY they help women. I doubt it’s really true – but give a few of them a call and see what kind of help they can offer you. You also might call the United Way. At least you could get baby clothes and formula and diapers. United Way can tell you who else to call to maybe help you with your utility bills and such.

Good luck and congratulations.

FMLA only applies to companies with more than 50 employees.

No – to be able to receive unemployment, you need to be able to work, actively looking for work and ready to accept a position to work immediately.

You might be able to take FMLA – family medical leave – this will allow you to have time off without losing your job (here is a website with all the guidelines including length of time you must have been employed, size of company, time off allowed circumstance etc – http://www.dol.gov/esa/whd/fmla/ ) . . . but unfortunately it is unpaid leave. From the sound of your question, you are looking for financial assistance.

Most women in the US do not receive paid leave – some are fortunate to be able to use short-term disability, the rest use vacation time and budget really well during their pregnancy to try to set aside money for while they are off. You can also look into aid programs like WIC, food stamps, medicare for insurance etc . . .

Good luck to you!

Unemployment is only if you don’t have a job, not if you’re not working for other reasons.

Disability might help you, though. Talk to your boss or HR department.

Actually your not protected under FMLA unless the company has 50 or more people working there…you cant get unemployment unless they fire you…you can try getting public assistance in the meantime…they give you medicaid and food stamps some cash also to help you out some…
