I’m 18 in school and Have a part time job. I have a Son that I Will Claim for my income tax and want to know if I can claim My 18 year old girlfriend also. Her parents told me she was to old, 16 is the oldest you can claim. But she isn’t working. We been living with her step dad with a agreed rent for a few months already, but we lived together for over a year. My girlfriend is a “Stay at home mom”. and Last year when i lived with my mom I helped her with the bills all year because she wasn’t working, let me claim my sister and i got 2,500. I
would of got only 500.
I think i made a little less or just at 9,000
We are hoping on at least 5,000 so we can get a second car.
So Can I Claim both my Girlfriend and my Son?
Also can her step dad claim her without her permission even tho she’s 18 and only been living here for a few months? I think they got in a argument about it.
I live in Texas. She moved in with me at my mom’s House in 09′. No she didn’t work at all in 2010. And I will be Claiming myself and my son he turns 6 months on the 29th.
I just want an idea if I can Claim her. or weather its Completely out the question.
And idk about all that legal stuff last year we went to H&R block so I’m sure if it wasn’t they’d of told us or something.
Also can her step dad claim her without her permission even tho she’s 18?

You can claim her as long as you are supporting her, I claim my girl friend, my daugher and grandma as well, and I pretty much support them

The answers you have so far aren’t correct. You can’t “claim her as your common law wife”. The person who just said “yes” might be right in your case, but there’s not enough info in your question to say for sure. Where did you live the rest of the year that you didn’t live with her stepdad? What state do you live in? Did your gf work at all in 2010, and if so how much did she make total? Would need all that info.
Her stepdad can’t claim her unless she lived with him over half the year. And it’s not correct that someone over 16 can’t be claimed – that’s for the child tax credit, not dependency, and you obviously wouldn’t be claiming your gf as your child.
You should be able to claim your son, unless someone can claim you as a dependent.
It’s not clear whether what you did last year was legal or not.

Did she live with you for the ENTIRE year of 2010? Did you provide more than 50% of her support? If you made $9000 it’s going to be VERY difficult to prove you supported yourself, your girlfriend AND your son.
